Can I use my Dubai property sale money to pay unpaid service charges?
Quick answer: possibly, through an agreed payment arrangement before ownership transfers. You should not plan to complete the sale and pay the overdue charges afterward. A buyer may agree to advance part of the purchase price to clear them, but the payment, clearance and buyer protections must be arranged first.
This guide covers owners reselling a completed Dubai apartment or villa with building or community service charges, rather than a developer selling a new property.

Can I transfer the property first and pay the service charges afterward?
For unpaid charges covered by Dubai's jointly owned property law, no. Article 32 of Law No. 6 of 2019 requires those charges to be paid before the property can be transferred.
For sales in freehold areas, Dubai Land Department requires the developer's electronic no-objection certificate, usually called an e-NOC. Nakheel's resale requirements include service-charge payment, including provisional charges (estimated amounts pending final billing).
Signing Form F, the buyer-seller sale agreement, is not the same as transferring legal ownership. The charges need a payment solution before the transfer can complete.
Can the buyer pay my unpaid service charges as part of the purchase price?
You can propose this, but the buyer does not have to agree. For example, Nakheel confirms that another person can pay service charges on an owner's behalf.
That payment option does not itself protect the buyer or create an approved sale-financing arrangement. Confirm your developer or management company's process, and have a property lawyer check the advance-payment terms before money is released.
When would that payment happen: during or after the sale?
During the sale process, before ownership transfers. For an agreed buyer-funded arrangement, the intended sequence is:
- Confirm the amount needed for clearance and the approved payment route.
- Sign the payment terms and agree how the buyer's advance counts toward the purchase price.
- Pay the charges, obtain the receipt and have management update the account.
- Obtain the required NOC once all its conditions are met.
- Complete ownership transfer and settle the remaining purchase price as agreed.
Do not assume the transfer office will automatically deduct service charges from the seller's final cheque.
How would the money work? A simple example
Illustration only: assume a sale price of AED 1,000,000, verified unpaid service charges of AED 20,000, and no other purchase-price payments already made. Mortgage repayments, selling fees and other adjustments are excluded.
- Before transfer: the buyer pays AED 20,000 directly through the approved service-charge payment route, under the written agreement.
- At transfer: the remaining purchase price is AED 1,000,000 - AED 20,000 = AED 980,000.
- Total paid toward the price: AED 20,000 + AED 980,000 = AED 1,000,000.
The buyer has not paid an extra fee or received a discount. Part of the agreed price has paid the seller's debt. AED 980,000 is the remaining price, not the seller's profit or final take-home amount.
What should we put in Form F or its addendum?
Make the payment arrangement specific. An addendum is a written addition to the agreement. Ask your property lawyer to document:
- The verified amount, recipient, payment method and deadline.
- The credit against the purchase price, including any deposit already paid.
- Who obtains the receipt, account clearance and NOC.
- What happens if the balance changes or clearance is delayed.
- Who repays the buyer, by when, and with what protection if the sale fails.
Paying the seller's bill does not give the buyer ownership. A promise to refund the advance is not the same as money being securely held and available for repayment.
Can I use the buyer's deposit cheque to pay the charges?
Do not assume you can cash or release it. Check Form F, any addendum and the instructions under which the deposit is held. Agree any change with the buyer and the person holding it before release.
If a deposit becomes part of the payment arrangement, record the amount used and avoid counting it twice when calculating the balance due.
What if my buyer is using a mortgage?
Confirm the funding sequence with the buyer's lender first. Mortgage approval should not be treated as confirmation that loan funds are available for your service charges before transfer.
Ask whether the buyer can fund the advance, whether the lender accepts the arrangement and how it affects the final payment. If your property also has a mortgage, include its settlement in the overall plan.
How do I check the amount, including advance charges or a disputed bill?
Request a dated statement showing the full clearance balance. Ask management to separate overdue charges, new or provisional charges, credits and other items.
DLD's service-charge guidance explains approved charges, the Service Charge Index and payment channels. The index helps check rates; it does not replace your property's account statement. After payment, send management the payment slip.
Query unexplained amounts in writing. If payment covers a period after transfer, agree any buyer-seller reimbursement separately. Do not assume a billing dispute or instalment plan allows transfer with unpaid charges.
What if the buyer refuses to advance the money?
You need another way to fund clearance before transfer. Discuss this early, before committing to a completion date. Simply reducing the asking price does not pay the outstanding bill or satisfy the clearance requirements.
Start by asking management: “Please confirm the full amount required for resale clearance, whether the buyer can pay it directly on my behalf, and what must be completed before you issue the NOC.”
