Already paid? What to do when a Dubai developer delays opening escrow

You have paid for an off-plan property, but the developer keeps saying the project's escrow account is still being opened. Start by getting written evidence of where your money went. Check the project with Dubai Land Department, keep a clear record of the responses and get advice before an existing payment or notice deadline passes.

This guide concerns delayed opening of a Dubai project's escrow account, the dedicated account for its off-plan buyer payments. It is for someone who has already paid a developer. If you have not paid yet, start with our before-payment escrow guide. A missing account is not the same issue as delayed construction or a refund delayed from an existing account.

Treat the explanation as a question to verify

RERA's developer circular of 19 March 2025 prohibits collecting project-related payments outside the designated escrow account. An assurance that the account will open soon does not establish where your payment is held now.

Ask which stage is actually incomplete: project registration, account opening, confirmation of the account details, or allocation of your payment. Those descriptions point to different missing evidence. Record what the developer says without treating an informal explanation as an official finding.

Our recommendation is to replace repeated verbal assurances with a written payment trail and an official enquiry. This guide does not create a standard waiting period or decide whether your individual agreement can be cancelled.

Build one file showing what happened

Start with the documents you already have. Preserve the original files and messages, including their dates. Put copies in a working folder rather than altering the originals.

Payment and document evidence for an escrow opening delay
Booking and sale documentsWhat to capture: Signed versions, unit, project, purchaser and developer namesWhy it helps: Identifies the agreement being discussed
Money actually paidWhat to capture: Date, amount, bank reference, recipient and receiptWhy it helps: Connects each payment to its destination
Payment instructionsWhat to capture: Invoice, account details and the message requesting paymentWhy it helps: Shows who instructed you to pay where
Account-opening promisesWhat to capture: Exact message, date, promised step and later responseWhy it helps: Builds a factual sequence without guessing motives
Upcoming obligationsWhat to capture: Instalment dates, notices and response deadlinesWhy it helps: Helps an adviser assess what needs attention first

Separate money paid from an invoice, an uncashed cheque or an amount merely promised. Mark gaps as “not confirmed”. If you do not have a signed document, ask for your copy and record that it is missing.

Download the escrow-opening delay action sheet. It helps you organise the payment trail and next actions; it is not a complaint form or legal notice.

Send a precise information request

Ask the developer for the registered project name and number, the account's current status, and the bank and account details if it has opened. Request written confirmation of the destination and treatment of every payment you made. If an exception is claimed, ask for the specific regulatory decision and check it with DLD.

You can adapt this factual request:

Subject: Project account and payment confirmation — [project / unit]

I paid [amount] on [date], using reference [reference], following your payment instructions. On [date], I was told that the project's escrow account was still being opened.

Please confirm the registered project name and number, whether its approved escrow account is now open, and the bank/account details if available. Please also confirm where my payment is currently held and provide the supporting receipt or allocation record.

If the account has not opened, please explain the current stage, the outstanding step and the date on which you expect to provide an update. If my payment is to be transferred, please provide confirmation when that happens.

Please also confirm how you propose to handle the upcoming payment or notice dated [date].

Use only facts and amounts you can support. Ask for a concrete reply date and keep the response with your file. This is an information request, not a template for terminating the purchase or serving a formal contractual notice. Use the required method in your agreement, with advice, if a formal notice is needed.

Check the project and account independently

Use DLD's Project Status Enquiry or the linked Dubai REST service to look up the exact project. Save the result and check date. If the project is missing or the account information is incomplete, contact DLD through its official contact page with your project details and evidence.

Explain the distinction between what you know and what you were told. For example: “My transfer receipt shows this beneficiary; the developer's email says the project account is not open.” Ask DLD to confirm the relevant project/account status and direct you to the appropriate enquiry or reporting channel. A blank search result alone does not prove fraud or tell you the correct remedy.

If sale registration is also missing, record it separately. DLD's development FAQs identify an application to its Real Estate Registration Assurance section, with supporting documents, where a developer refuses or delays registering the sale contract. Ask DLD how that route applies to your documents; opening an account is not proof that your individual sale has been registered.

Use the right route for the outcome you need

For a suspected breach of real estate rules, DLD provides a Complaint Against a Real Estate Company service. Check eligibility first and support a report with the company, project, payment instructions and relevant documents.

The published service terms exclude contractual disputes, cancellation, refunds and compensation. They also say complaints involving contracts more than six months old are not considered through that service. If that may affect you, ask DLD which channel applies and obtain legal advice. Do not interpret a service restriction as a general deadline for every possible court claim.

The complaint entry page says the system is for regulatory violations and that complaints may be sent to company officials for a response. Prepare accurate supporting material and use the proper private channel. A regulatory complaint is not a refund application, and a response or closure notice does not establish that money has been returned.

If your objective is to cancel, recover money or claim compensation, have a qualified Dubai real estate lawyer review the signed documents, payments, correspondence and appropriate dispute route. Keep any DLD reference and reply in the same file. Do not wait for repeated assurances if a legal or contractual deadline needs attention.

Do not leave the next instalment unanswered

An approaching payment request needs its own response. Raise the unresolved account issue in writing and obtain advice on your current obligations, the correct payment destination, any proposed extension and required notices.

Do not simply ignore an instalment or assume that filing a complaint pauses the contract. Equally, do not treat a fresh demand for money as proof that the account problem has been resolved. If an extension or other arrangement is agreed, have it properly recorded; an unanswered request is not an agreed change.

Avoid signing a replacement booking, project swap, release or settlement just to end the correspondence without understanding what it changes. Ask your adviser to check the price, payment treatment and effect on any existing claim before you agree.

If the account finally opens, trace your earlier payment

DLD's FAQs state that payments already received from buyers must be deposited into escrow when the developer opens the account. Ask for evidence covering your earlier payment, not only a letter showing that an account now exists.

Once your money is deposited, Article 12 of Law No. 8 of 2007 allows depositors or their representatives to access their own accounting records and request copies. Ask the escrow agent about the process and evidence needed to identify your deposit. This is not a right to other buyers' records or a conclusion that every earlier issue has been resolved.

Reconcile the amount and date against your transfer confirmation, the unit allocation and the developer's statement. Keep any unexplained difference open on the action sheet until it is answered. Account opening, crediting your money and resolving a contractual dispute are separate checks.

Common questions

How long should I wait for the developer to open escrow?

Do not rely on a generic waiting period. Request the current stage and a written update, verify the project/account position with DLD and act on your own contract or notice deadlines with advice. This guide does not establish a universal grace period.

Can I stop paying because the project account is delayed?

Do not make that decision from this guide alone. Raise the issue promptly, have your agreement and payment destination reviewed, and seek a documented solution before the relevant deadline. A complaint is not confirmation that an instalment has been paused.

Will a DLD violations complaint get my deposit refunded?

That service does not determine contractual refund or cancellation claims. Check its eligibility and use it for the relevant suspected rule violation. Obtain advice on the appropriate route for recovering money.

The account has opened. Is the issue finished?

Check that your earlier payment was actually credited and correctly allocated to your purchase. Account details alone do not show the history of your funds or settle an existing dispute.

Does the missing account mean the developer is fraudulent or distressed?

Do not draw that conclusion from an unresolved account issue alone. Record verifiable facts and use the appropriate official or legal route. This guide makes no allegation about a named developer or project.
