Is it safe to buy Dubai off-plan property without a project escrow account?

If the developer says the project's escrow account is still being opened, our recommendation is to wait before making a new purchase payment. A promise that the money will be moved later is not the evidence you need today. First verify the exact project, its approved account and where your payment would go.

This guide is for someone considering an off-plan purchase directly from a developer in Dubai. “Off-plan” means buying before the property is completed. An escrow account is a dedicated project account with rules governing the money paid into it. This guide does not assess any named developer or decide an existing buyer's contract dispute.

The account belongs to the project

Under Dubai's Law No. 8 of 2007, Articles 7 and 9, off-plan buyer payments are deposited into an account in the project's name, with separate accounts for separate projects. The account is restricted to that project's development and protected from attachment by the developer's creditors.

That distinction matters when you receive bank details. A company's normal business account, an agent's account or an account for another development does not establish that you are paying into this project's escrow. A familiar logo on an invoice is not enough to resolve that question.

“We will open it later” is not a payment check

RERA Circular 02-2025, dated 19 March 2025, addresses developers marketing projects before registration and escrow opening. It identifies that practice as a violation and prohibits collecting project-related payments outside the designated escrow account.

The later Circular 01-2026, dated 5 January 2026, tells brokers to verify project registration, an approved escrow account and the required marketing permit before promotion. DLD lists this notice on its website under 8 January 2026; that listing date differs from the document's date.

For a buyer, the practical conclusion is straightforward: ask for verifiable current evidence. Do not let a launch deadline, a promised discount or a reassuring message take its place. This is a check on a proposed transaction, not an accusation against a company.

Verify these details before a new payment

Identify the exact project. Request its registered name, project number, developer's legal name and the unit being offered. Match these across the reservation documents, payment request and official record. Similar marketing names should not leave you guessing which development you are buying into.

Check the official project record. Start with DLD's Project Status Enquiry, which offers a search by project name or number and an Escrow Account section. The page also points to Project Status (Mashrooi) in Dubai REST. Record what you checked and when. A blank result or missing account detail is a reason to seek confirmation; it does not, by itself, prove fraud or an exemption.

Match the account independently. Ask for the bank, beneficiary name and account/IBAN details in writing. Compare them with the project record and obtain clarification through DLD's official contact channels if anything is missing or inconsistent. Use contact details you obtain independently; do not rely solely on a number printed in the payment message you are checking.

Check the payment itself. Establish who is requesting it, what it pays for, which unit it relates to and whether it will count toward the purchase price. Ask for a written breakdown when a request mixes purchase money and separate charges. Resolve the destination for each component before authorising a transfer.

Read what you are signing. Review the price, instalments, allocation terms, refund conditions, deadlines and cancellation wording. Account verification does not replace a review of the agreement. If a point materially changes your exposure, have a qualified adviser explain it before you sign.

What if the payment is called an EOI or reservation fee?

An “expression of interest” or EOI usually describes an early indication that you want to buy. The label alone does not tell you where money will be held, what commitment you are making or when it can be returned.

Ask whether the requested money is connected to the project purchase and obtain the payment and refund terms in writing. Do not assume that calling a payment “refundable”, “pre-launch” or a “reservation” creates an exception to the escrow rules. The March 2025 circular's restriction covers project-related collections, not only payments labelled instalments.

If someone claims an exception, request the specific regulatory decision and verify its application to this project and proposed payment with DLD/RERA. DLD's development FAQs mention exceptions within RERA's authority in a discussion of projects announced before the law. That is not a general permission for a new launch to collect money while waiting for an account.

Use a short evidence sheet

Keep these questions together before making your decision:

Before-payment escrow evidence checks
Is this the exact registered project?Evidence to keep: Project name/number and dated official checkIf unresolved: Ask DLD to clarify the identity or status
Is this its approved escrow account?Evidence to keep: Matching bank/account details and verification referenceIf unresolved: Request confirmation before a new payment
What is this payment buying?Evidence to keep: Written amount, purpose, unit and destinationIf unresolved: Request a clear breakdown
What have I agreed to?Evidence to keep: Reservation/sale terms and any written explanationIf unresolved: Have unclear commitments reviewed
Is an exception being claimed?Evidence to keep: Specific regulatory decision and confirmationIf unresolved: Do not rely on a sales assurance

Download the before-payment escrow checklist. Mark missing evidence as missing; do not convert an unanswered question into a tick. This is our practical worksheet, not an official approval form.

Does verified escrow make the whole purchase safe?

No single account check decides whether a property is a suitable purchase. You still need to assess affordability, the agreement, delivery expectations and what you would do if your circumstances change.

Article 15 of Law 8/2007 provides for measures involving the escrow agent and DLD when emergency circumstances prevent completion. It does not promise each buyer immediate repayment on demand. Do not treat escrow as a guarantee of a delivery date, investment return or an unrestricted refund.

If your concern is already about a late handover, our Dubai handover-delay guide covers that separate situation. A project account and the property's delivery obligations need different checks.

If you have already paid

Our guide to delayed escrow opening after payment provides a written-request template and an evidence/action sheet for this situation.

Keep your agreement, receipts, transfer confirmation, payment instructions and correspondence together. Ask in writing where your money was credited, and contact DLD for the appropriate project/account enquiry route. Have a qualified adviser review your agreement and any approaching payment or notice deadline.

Do not interpret this before-payment recommendation as an instruction to cancel an existing agreement or stop instalments without advice. A regulatory concern, a complaint and a contractual refund claim are different matters; this guide does not decide the outcome of any of them.

Common questions

Is a developer's general company account enough?

No. Verify the approved account for the exact project before making a new purchase payment. The fact that an account belongs to a known company does not establish that it is the project's escrow account.

Does a promise to transfer my money into escrow later resolve the issue?

No. Ask for current account and payment-destination evidence. Our recommendation is to wait while that evidence remains unresolved rather than fund the purchase on a promise of later action.

Does a missing Dubai REST result prove the project is unlawful?

No. A missing search result is inconclusive. Confirm the project identity and status directly with DLD before drawing a conclusion or making a new payment.

Is a refundable booking payment automatically outside the escrow rules?

Do not assume so. Obtain its purpose and terms in writing, and verify any claimed regulatory exception. A payment label or refund promise alone does not establish permission to collect project money elsewhere.

Can I cancel and get my money back if there is no escrow account?

This guide cannot determine that from the account issue alone. Keep the payment evidence and obtain advice on your signed documents, facts and available routes. Do not assume an automatic refund or ignore an existing deadline.
